Welcome to Gathered Goods! These Terms & Conditions (“Terms”) govern your use of our website, platform, and services. By accessing or using Gathered Goods, you agree to comply with these Terms. If you do not agree, please refrain from using our services.
1. Definitions
- “Gathered Goods” refers to the Gathered Goods online marketplace, including its website and services.
- “Vendor” refers to any business, maker, seller, or individual listing products or services on Gathered Goods.
- “Customer” refers to any individual or entity purchasing goods or services through Gathered Goods.
- “Platform” refers to the Gathered Goods website and any associated technology facilitating transactions.
- “We,” “us,” or “our” refers to Gathered Goods.
2. User Eligibility & Account Registration
- Users must be at least 18 years old to create an account or make purchases.
- Vendors must provide accurate business and contact information.
- Users are responsible for maintaining the confidentiality of their account credentials.
- Gathered Goods reserves the right to suspend or terminate accounts for violation of these Terms.
3. Vendor Terms
- Vendors must comply with all applicable laws and regulations regarding product sales and safety.
- Vendors are responsible for fulfilling orders in a timely and professional manner.
- Gathered Goods charges a $50/month platform fee (waived for individual makers with social media promotion), a $100/month delivery platform fee (if applicable), and a 6% commission on sales.
- Vendors grant Gathered Goods a limited, non-exclusive license to use product images and descriptions for promotional purposes.
- Vendors are responsible for handling customer inquiries, returns, and disputes related to their products.
- Vendors may not list prohibited or illegal items as determined by Gathered Goods’ policies.
4. Customer Terms
- Customers agree to provide accurate payment and shipping information.
- Orders are subject to availability, and vendors reserve the right to cancel orders if necessary.
- Gathered Goods facilitates transactions but does not directly sell or manufacture any listed products.
- Customers are responsible for reviewing vendor policies regarding returns and refunds before making a purchase.
- Gathered Goods is not responsible for damages, losses, or disputes arising from vendor transactions.
5. Payments & Fees
- Payments are processed securely through our third-party payment provider.
- Gathered Goods collects applicable platform fees and commissions as outlined in the Vendor Terms.
- Sales tax, if applicable, is calculated at checkout based on local laws.
- Vendors receive payouts based on a pre-determined schedule, minus applicable fees.
6. Delivery & Order Fulfillment
- Orders may be fulfilled via vendor pickup, local delivery, or scheduled pickup from a Gathered Goods hub.
- Delivery services are subject to availability and fees.
- Customers are responsible for ensuring their delivery address is correct.
- Gathered Goods is not liable for delivery delays caused by vendors or third-party carriers.
7. Prohibited Activities
Users may not:
- Use Gathered Goods for fraudulent or illegal activities.
- Interfere with the proper functioning of the platform.
- Post false or misleading product information.
- Abuse or harass vendors, customers, or staff.
8. Intellectual Property
- All content on Gathered Goods (excluding vendor listings) is owned by or licensed to us.
- Users may not copy, distribute, or use platform content without permission.
9. Privacy & Data Protection
- We collect and process personal data in accordance with our Privacy Policy.
- Users consent to the collection and use of their data for order processing, account management, and platform improvements.
- Gathered Goods does not sell user data to third parties.
10. Limitation of Liability
- Gathered Goods is a facilitator of transactions and is not liable for product defects, damages, or vendor misconduct.
- Our total liability to any user shall not exceed the total amount paid by that user in the past six months.
- We are not responsible for service interruptions due to technical issues, third-party failures, or force majeure events.
11. Dispute Resolution
- Users agree to resolve disputes informally by contacting Gathered Goods support.
- If disputes cannot be resolved, they will be subject to arbitration in accordance with Wisconsin law.
12. Amendments & Updates
- We reserve the right to update these Terms at any time.
- Users will be notified of material changes via email or on our website.
- Continued use of Gathered Goods after updates constitutes acceptance of the revised Terms.
